We are proud to announce a remarkable achievement by our team in securing the recognition and enforcement of a DIFC-LCIA Arbitral Award totaling USD 48 million before the DIFC Courts.
Our team successfully represented our client in proceedings for the Recognition and Enforcement of an Arbitration Award under DIFC Court Rule 43(62) and Article 42(1) of the Arbitration Law. Despite persistent jurisdictional objections, applications to set aside the enforcement order, and an appeal against the judgment, the DIFC Court of Appeal dismissed the appeal, affirming the enforceability of the arbitral award.
The appeal raised intricate issues, including alleged conflicts between DIFC Court rulings and Dubai Bankruptcy Court orders, alongside public policy defenses. Our team addressed these challenges by demonstrating the compatibility of enforcing the award with UAE public policy and legal principles. Comprehensive submissions emphasized and successfully conveyed that procedural discrepancies do not amount to a breach of public policy, compelling the Court to affirm that public policy defenses must meet a significantly high threshold.
